ECONOMIC DEVELOPMENT COMMITTEE, CITY STAFF AND THE GENERAL PUBLIC. THANK YOU FOR ALLOWING ME THE OPPORTUNITY TO SPEAK TONIGHT. I DEEPLY CARE ABOUT SEAGOVILLE AND HOW TAXPAYER DOLLARS ARE USED TO BUILD A STRONG, STABLE FUTURE FOR OUR CITY. I OBJECT TO THE CURRENT FORM OF THE SEAGOVILLE ECONOMIC ANNUAL REPORT 2025, AND ASK YOU TO AMEND THE 2025 ANNUAL REPORT BEFORE IT IS APPROVED FOR THE FOLLOWING REASONS. TRANSPARENCY AND ECONOMIC DEVELOPMENT, SPENDING AND ACCOUNTABILITY REGARDING THE ANNUAL REPORT AND THE PT ATLAS GRANT IN AUGUST OF 2023. IT IS MY UNDERSTANDING THE SEAGOVILLE ECONOMIC DEVELOPMENT COMMISSION APPROVED A PERFORMANCE BASED GRANT OF 375,000 TO PT ATLAS MANUFACTURING, LLC. THE GOAL OF THE AGREEMENT WAS POSITIVE AND REASONABLE. AT LEAST 12 NEW JOBS, WITH APPROXIMATELY 997,000 IN PRIVATE CAPITAL INVESTMENT. UNFORTUNATELY, THE PROJECT DID NOT PROCEED AS PLANNED. PT ATLAS WAS SOLD TO ANOTHER COMPANY, PLACING THE BUSINESS OUT OF COMPLIANCE WITH THE AGREEMENT TO THE CITY'S CREDIT. ENFORCEMENT ACTION WAS TAKEN. THE EDC EXERCISED ITS CONTRACTUAL RIGHT TO DEMAND REPAYMENT OF UP TO 80% OF THE GRANT. IF I UNDERSTAND THE TERMS CORRECTLY, EQUALS $300,000 AND THE MAXIMUM ALLOWED UNDER THE AGREEMENT. HOWEVER, THE 2025 ANNUAL REPORT DOES NOT CLEARLY STATE HOW MUCH OF THE GRANT WAS ACTUALLY REPAID. HOW MUCH, IF ANY, REMAINS OUTSTANDING. WHETHER TAXPAYERS WERE MADE WHOLE. WHEN PUBLIC MONEY IS INVOLVED, RESIDENTS DESERVE TO KNOW EXACTLY AND WHAT HAPPENED TO IT. TRANSPARENCY AND ACCOUNTABILITY MATTERS. IT PROVIDES CLEAR AND COMPLETE REPORTING, BUILDS TRUST WITH RESIDENTS, PROTECTS THE CITY FROM SPECULATION AND MISINFORMATION, DEMONSTRATES RESPONSIBLE STEWARDSHIP OF TAXPAYERS DOLLARS. TRANSPARENCY IS A COMMITMENT TO HONESTY AND ACCOUNTABILITY. SIMPLY STATING EXACT REPAYMENT AMOUNTS AND BALANCES OWED WOULD ELIMINATE CONFUSION AND REINFORCE PUBLIC CONFIDENCE. FOR THESE REASONS, I OBJECT TO THE 2025 ANNUAL REPORT. UNTIL THESE OBJECTIONS ARE FULFILLED IN THEIR ENTIRETY. I DO NOT SUPPORT A VOTE OF APPROVING THE 2025 ANNUAL REPORT DUE TO ITS NOT COMPLETE WITH TRANSPARENCY AND ACCOUNTABILITY AS IT SHOULD BE AT THIS TIME, FOR THE BENEFIT OF SEAGOVILLE RESIDENTS AND ECONOMIC DEVELOPMENT COMMITTEE.

I WOULD ALSO LIKE TO SUGGEST A VERY STABLE AND FAMILY FOCUSED USE OF ECONOMIC DEVELOPMENT FUNDS, IN ADDITION TO SUPPORTING BUSINESSES IN THE COMMUNITY. IT IS BUSINESS

RELATED. INSTEAD OF RELYING PRIMARILY ON LARGE, HIGH RISK CORPORATE GRANTS. WE COULD CONSIDER A FIRST TIME HOME BUYER GRANT PROGRAM IF THERE'S NOT ALREADY ONE IN PLACE, AND USE FUNDS ALLOCATED FROM THE ECONOMIC DEVELOPMENT FUNDS. I SUGGEST THIS PROPOSED PROGRAM WOULD OFFER 10,000 UP TO 30,000 IN ASSISTANCE FOR FIRST TIME HOME BUYERS, HELPING THE HOMEBUYER ACHIEVE THE AMERICAN DREAM OF HOME OWNERSHIP AND HELPING THE HOME BUILDER MORE EASILY SELL THEIR HOMES. THE MONEY WOULD BE USED FOR DOWN PAYMENT AND CLOSING COSTS FOR THE HOME BUYER. IT SHOULD BE AVAILABLE TO QUALIFIED FIRST TIME HOME BUYERS. THIS TYPE OF INVESTMENT BUILDS THE CITY FROM THE INSIDE OUT. FOR MANY FAMILIES, RENTING MEANS PAYING FOR 20 TO 30 YEARS WITH NOTHING TO SHOW FOR IT EXCEPT HELPING SOMEONE ELSE BUILD WEALTH. HOME OWNERSHIP OFFERS STABILITY FOR FAMILIES AND CHILDREN. PRIDE AND RESPONSIBILITY IN THE COMMUNITY. LONG TERM FINANCIAL SECURITY A PATHWAY TO THE AMERICAN DREAM. HELPING FAMILIES BUY HOME INSTEAD OF RENTING KEEPS PEOPLE ROOTED IN SEAGOVILLE. IT STRENGTHENS NEIGHBORHOODS, STABILIZES THE TAX BASE, AND CREATES RESIDENTS WHO ARE INVESTED IN THE CITY'S FUTURE, NOT JUST TEMPORARY OCCUPANTS THAT ARE TRANSIENT, USUALLY FOUND IN APARTMENT DWELLERS. THIS PROGRAM CAN BE STRUCTURED RESPONSIBLY AND LEGALLY WITH PROTECTIONS SUCH AS HOMES MUST BE OWNER OCCUPIED. A FIVE YEAR MINIMUM RESIDENCY REQUIREMENT. IF THE HOME IS SOLD EARLY, THE GRANT IS REPAID. THIS WOULD RESOLVE AFFORDABILITY ISSUES FOR FAMILIES, STRENGTHEN SEAGOVILLE WITHOUT BRINGING MORE APARTMENTS INTO COMMUNITIES, AND USUALLY ARE NOT GOOD FOR COMMUNITIES. SOUTHLAKE, TEXAS DOES NOT ALLOW APARTMENTS TO BE BUILT IN THE CITY SINCE THEY KNOW HOW DETRIMENTAL APARTMENTS ARE TO THE CITY. IF YOU'RE NOT FAMILIAR WITH SOUTHLAKE, THEN YOU SHOULD GO LOOK AT IT. I REQUEST THAT THE ECONOMIC DEVELOPMENT COMMISSION PLACE AN ITEM ON THE NEXT PROPOSED AGENDA TO REVIEW, VOTE AND MAKE A RECOMMENDATION TO THE CITY MANAGER AND CITY COUNCIL REGARDING THE CONTINUED EMPLOYMENT OF BILL MEDINA, DIRECTOR OF ECONOMIC DEVELOPMENT COMMISSION, AND TO THE CITY COUNCIL CONCERNING THE CONTINUED ENGAGEMENT OF THE CITY LEGAL COUNSEL. NICHOLS AND JACKSON. THIS IS BASED ON DOCUMENTED PROCEDURAL FAILURES, ADMITTED CONDUCT, AND LEGAL CONCERNS RELATED TO COMPLIANCE WITH TEXAS ZONING AND CONFLICT OF INTEREST LAWS. THIS IS NOT ABOUT PERSONAL GRIEVANCES. IT'S ABOUT PROCESS INTEGRITY, LAWFUL GOVERNANCE, AND PUBLIC TRUST. ON NOVEMBER 1ST, 2023, A DOCUMENTED MEETING TOOK PLACE AT THE CITY'S OFFICE IN ATTENDANCE, WHERE MY WIFE PATRICIA AND I, AS WELL AS FORMER CITY MANAGER PAT STALLINGS, ASSISTANT CITY MANAGER CINDY BROWN, CITY SECRETARY SARAH EGAN, EDC DIRECTOR BILL MEDINA AND HIS ASSISTANT CITY ATTORNEY VICTORIA THOMAS WITH NICHOLS JACKSON JACKSON LAW FIRM.

DURING THAT MEETING, IT WAS ACKNOWLEDGED THAT A REQUIRED PROPOSED ZONING NOTICE SIGN PLACED ON SEAGOVILLE ROAD BY BILL MEDINA WAS NOT VISIBLE DUE TO OVERGROWN WEEDS AND GRASS THAT NO ZONING SIGN HAD BEEN, AND THAT NO ZONING SIGN HAD BEEN PLACED ON KANE STREET. MR. MEDINA ADMITTED THAT HE PERSONALLY PLACED THE SIGN ON SEAGOVILLE ROAD, AND THAT HE DID NOT PLACE A SIGN ON KANE STREET. THESE FACTS ARE ADMISSIONS PRESERVED IN AN AUDIO RECORDING, TRANSCRIPT AND PHOTOS, OPPOSITION TO ZONING PETITION AND AFFIDAVIT IN WHICH ARE AVAILABLE AND PROVIDED TO BECOME A PERMANENT PART OF TONIGHT'S MEETING. OF THOSE IN THE ENVELOPE, I WILL GIVE YOU WHEN I FINISH BILL MEDINA AND VICTORIA THOMAS FAILED TO CORRECT KNOWN VIOLATIONS AFTER THESE ISSUES WERE IDENTIFIED, THE REQUIRED SIGN ON KANE STREET WAS NEVER PLACED. 6TH, 2023, THE ZONING PROCESS CONTINUED WITHOUT CORRECTION. UNDER TEXAS ZONING LAW, NOTICE REQUIREMENTS ARE MANDATORY, NOT OPTIONAL. WHEN NOTICE IS DEFECTIVE, THE PROPER RESPONSE IS TO PAUSE, RESET THE PROCESS, NOT PROCEED. I HAVE ADDITIONAL CONCERNS. MORE RECENTLY HAS BEEN STATED PUBLICLY THAT FORMER MAYOR AT THAT TIME ALLEGEDLY THREATENED MR. MEDINA'S JOB IF CERTAIN ACTIONS WERE NOT TAKEN. IF TRUE, THIS PRESENTS A SERIOUS CONCERN WHEN A CITY EMPLOYEE BELIEVES THEY'RE BEING DIRECTED TO PERFORM UNLAWFUL ACTIONS. THE PROPER RESPONSE IS TO REPORT THAT CONDUCT TO LAW ENFORCEMENT, THE CITY COUNCIL OR APPROPRIATE OVERSIGHT AUTHORITIES. CONDUCTING ACTIONS BELIEVED TO BE UNLAWFUL IS NOT AN ACCEPTABLE OPTION, REGARDLESS OF PRESSURE. THE CITY ATTORNEY WAS PRESENT DURING THE NOVEMBER 1ST MEETING. IT WAS MADE AWARE OF OBSTRUCTED SIGNAGE, MISSING SIGNAGE, PROCEDURAL DEFECTS, LACK OF NOTICE AND OFFICIAL SUBMISSION OF THE ZONING OPPOSITION. THE APPROPRIATE ACTIONS SHOULD HAVE BEEN TO ALTER DELAY THE ZONING PROCESS SCHEDULED FOR NOVEMBER 6TH UNTIL COMPLIANCE WAS ACHIEVED. ONE MINUTE SIR, THAT DID NOT OCCUR. THE CITY ATTORNEY REPORTEDLY GAVE LEGAL ADVICE THAT COUNCIL MEMBER JOHN EPPS COULD VOTE ON THE ZONING MATTER.

TEXAS ZONING LAWS ARE NOT LIMITED TO OWNERSHIP OF SUBJECT PROCESS PROPERTY, A ZONING CHANGE THAT INCREASES THE VALUE BY $202,500 FOR ADJACENT PROPERTY OWNED BY A CLOSE FAMILY MEMBER OF CITY COUNCIL. PERSON RAISES SERIOUS CONFLICT OF INTEREST CONCERNS JOHN EPPS IS MARRIED TO THE ADJOINING LANDOWNER'S DAUGHTER, AND HE CAN INHERIT IN THE MANNER. THE ADC HAS A DUTY TO PLACE THIS ON THE NEXT AGENDA TO PROTECT THE CITY FROM LEGAL EXPOSURE AND SURE LAW. LAWFUL ECONOMIC DEVELOPMENT PRACTICES. FAILING TO PLACE THESE ITEMS ON THE NEXT AGENDA. WE INTRODUCED TWO NEW GRANT PROGRAMS. WE HAD SEVERAL DIFFERENT MAJOR DOWNTOWN PROJECT INITIATIVES. WE HAD DIFFERENT DOWNTOWN INFRASTRUCTURE UPGRADES AND THEN SEVERAL DIFFERENT COMMUNITY SPOTLIGHT OPPORTUNITIES. SO JUST OUT OF FLASH, THOSE ARE KIND OF THE NUMBERS. WHEN I LOOKED BACK AT THE YEAR REVIEWING ALL THE DIFFERENT AGENDA ITEMS AND PROJECTS THAT WE WORKED ON, I IDENTIFIED A FEW DIFFERENT CORE THEMES FOR THIS BOARD, AND THEY KIND OF ARE REFERENCED BEFORE IN THE NUMBERS, BUT DOWNTOWN REVITALIZATION IS CLEARLY A CORE VALUE OF THE BOARD. LOTS OF OUR AGENDA ITEMS ARE RELATED TO IT, AND A LOT OF OUR PROJECTS ARE RELATED TO IT. WE HAVE THE NEW GRANT PROGRAMS,

ONE OF WHICH IS DOWNTOWN SPECIFIC, AND IT'S THE NEW ONE, THE NEW DOWNTOWN DESTINATION GRANT PROGRAM, AS YOU ALL RECALL. SO WE HAVE THAT SET UP TO HELP GRANT FUNDS TO NEW BUSINESSES IN OUR DOWNTOWN. AND WE ALSO UPDATED AND AMENDED, RESTATED OUR FACADE GRANT PROGRAM AS WELL. WE INTRODUCED SEVERAL NEW WAYFINDING SIGNS THAT WERE INSTALLED ALL ACROSS TOWN, BUT DIRECTING TRAFFIC TOWARDS DOWNTOWN. WE DID THE RESTRIPING ALONG THE PARKING SPOTS OF DOWNTOWN. WE UPDATED SEVERAL DIFFERENT LEASE AGREEMENTS, AND THEN I WAS USING THE PLACER AI TO KIND OF LOOK AT THE RESULTS, BECAUSE DOBELL IS OPENED JANUARY OF 2025, SO WE HAVE ABOUT A YEAR'S WORTH OF DATA. THE TRAFFIC COUNTS HANG ON. WE'LL GO BACK THE IT'S OKAY. THE TRAFFIC COUNTS BEFORE IN 2020 4TH JANUARY 2024, WERE ABOUT 31,000 IN THE DOWNTOWN AREA. AND NOW DOBELL IS THERE. IT'S DOUBLED. IT'S OVER 62,000. SO I THINK THAT'S JUST VERY IMPRESSIVE. MAYBE NOT ALL OF THAT'S GOING TO DOBELL'S, BUT SIGNIFICANTLY HAS INCREASED TRAFFIC DOWN THERE. ONE OF THE OTHER MAJOR FOCUSES WAS BUSINESS RECRUITMENT AND EXPANSION, WHICH I THINK THE BIGGEST HIGHLIGHT OF IS THE MONSTER MINI GOLF AGREEMENT THAT WE PUT TOGETHER. THERE'S REVIEWING THE BIDS FROM CONTRACTORS RIGHT NOW, BUT THE MONSTER MINI GOLF SHOULD BE OPEN LATER THIS YEAR, SO THEY'RE REALLY EXCITED ABOUT THAT AND COORDINATING. THEY'RE IN CONTACT WITH STAFF ON IT. WE ALSO DID SOME NEW ADVERTISING OPPORTUNITIES, INCLUDING D MAGAZINE. THEY HAD A SPOTLIGHT ON SEAGOVILLE, AND THEN WE DID AN INTERVIEW WITH BUSINESS MAGAZINE, WHICH WILL BE POSTED HERE SOON. IT'S EITHER IN JANUARY OR FEBRUARY, SO WE'RE GETTING OUR NAME OUT THERE MORE, AND THEN COMMUNITY INVESTMENT AND QUALITY OF LIFE. OBVIOUSLY, WE HAVE THE QUALITY OF LIFE PROJECT. THE SKATE PARK WAS COMPLETED IN EARLY Q1 OF 2025, AND THEN WE'VE DECIDED TO DETERMINE TO ALLOCATE FUNDS TOWARDS THE BRUCE PARK ENGINEERING FOR THE RETAINING WALLS THAT SHOULD GO AROUND THE POND. WE'RE WORKING WITH THE CITY ENGINEER ON THAT TO TO DEVELOP THAT WORK, AND THEN WE'RE CONTINUING TO INVEST IN ADVERTISING OPPORTUNITIES FOR KID FISH, LIONS CLUB AND SISA.

SO WE'RE CONTINUING TO INVEST IN OUR COMMUNITY AND ADVERTISING THE CITY'S NAME OUT THERE. THE NEXT ONE IN TERMS OF FINANCES. SO THE THREE CHARTS YOU'RE ABOUT TO SEE, I DO WANT TO NOTE AT THE BEGINNING THIS IS SALES TAX FOR THE ENTIRE CITY. IT'S NOT JUST THE X PORTION OF SALES TAX. SO JUST KEEP THAT IN MIND. WE GET A ROUGHLY 25% OF THE OVERALL SALES TAX THAT THE CITY RECEIVES. BUT IN TERMS OF THE SALES TAX COLLECTIONS, TOTAL COLLECTIONS GOING BACK TEN YEARS OR JUST ABOUT TEN YEARS, SALES TAX IS INCREASED A LOT, ALMOST DOUBLED IN SIZE, JUST UNDER 3 MILLION. AND NOW WE'RE AT ABOUT 6 MILLION CITYWIDE. SO IT'S CONTINUING TO TREND UP. YOU CAN SEE THE GROWTH WAS KIND OF STUNTED IN 2020 DUE TO COVID, BUT THEN IT REBOUNDED PRETTY NICELY IN 21 AND ESPECIALLY IN 22. SO WE'RE CONTINUING TO TREND FORWARD. NEXT SLIDE. IF YOU CAN COMPARE THE INDIVIDUAL MONTHS THE GREEN IS THE 2025 YEAR SALES TAX DATA. SO WE HAD JANUARY THROUGH OCTOBER. BUT YOU CAN SEE IS WHAT'S SHOWN ON THE SLIDE. BUT YOU CAN SEE THAT GREEN IS NEVER BELOW THE PREVIOUS TWO YEARS AND IN SEVERAL CASES IS SIGNIFICANTLY HIGHER THAN PREVIOUS YEARS. SO OUR EXCEPT SEPTEMBER MAY MAY IS AN OUTLIER. EXCUSE ME MAY IS AN OUTLIER IN SEPTEMBER IS AN OUTLIER. BUT BUT OVERALL THE SALES TAX COLLECTIONS ARE UP SIGNIFICANTLY OVER 23 AND 24. AND THEN THIS IS JUST THE THIS IS SPECIFIC TO THE EDC AND IT'S OUR FUND BALANCE. IF YOU LOOK BACK AT 2015, OUR FUND BALANCE WAS JUST OVER $500,000. THE BOARD HAS BEEN PROACTIVE IN SAFEGUARDING THAT. AND SO OUR FUND BALANCE HAS CONTINUED TO INCREASE. WHERE NOW WE'RE AT ABOUT 4.2 MILLION JUST UNDER THAT.
